Overseas Vietnamese Property Ownership Rights Under Vietnam Land Law 2024

Effective August 1, 2024, the revised Land Law 2024 (Law No. 31/2024/QH15) marked a historic reform in Vietnam's real estate regime. Overseas Vietnamese—commonly referred to as Viet Kieu—now enjoy identical land use and property ownership rights to domestic citizens, eliminating previous restrictions and the high-risk practice of nominating local nominees.

  • Receive direct issuance of the Certificate of Land Use Rights and Ownership of Property (commonly known as the Pink Book) in their own legal name.
  • Freely transfer, mortgage, bequeath, lease, and donate properties within Vietnamese jurisdiction without requiring domestic proxies.

To register ownership, an overseas buyer must provide recognized documentary evidence demonstrating Vietnamese origin:

  • Retained Citizenship: A valid Vietnamese Passport or National ID card.
  • Foreign Citizenship: A valid foreign passport accompanied by a formal Certificate of Vietnamese Origin issued by a Vietnamese Embassy, Consulate, or domestic Department of Justice.
  • Historical identification documents such as birth certificates or family registers proving lineage.
